AGREEMENT TO TERMS

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and The Care Pharmacy (“we,” “us,” or “our”), concerning your access to and use of the https://www.thecarepharmacy.com/ website as well as any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”).

By accessing or using the Site, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with these Terms, you are expressly prohibited from using the Site and must discontinue use immediately.

We reserve the right, in our sole discretion, to make changes or modifications to these Terms and Conditions at any time and for any reason. Changes will be indicated by updating the “Last updated” date at the top of this page. It is your responsibility to review these Terms periodically. Continued use of the Site after updates constitutes acceptance of any changes.

The information provided on the Site is not intended for distribution to or use by any person or entity in any jurisdiction where such use would be contrary to law or regulation or subject us to registration in such jurisdiction. The Site is intended for users aged 18 and over.

We may use third-party couriers such as Royal Mail to deliver your prescriptions (“Partners”).


CHANGES TO OUR TERMS AND CONDITIONS

We reserve the right to make reasonable modifications to these terms at any time without notice by posting updates on this page. Continued use of our services after such modifications will constitute your acceptance of the updated terms.


ELECTRONIC PRESCRIPTION SERVICE SIGN UP

By using our Pharmacy, you agree to nominate The Care Pharmacy as your NHS EPS (Electronic Prescription Service) pharmacy. This ensures your electronic prescriptions are sent directly to us for dispensing and delivery. We may verify or re-confirm your nomination status with NHS systems to ensure prescriptions are correctly routed.

If you wish to remove your nomination at any point, please contact us, and we will update it within two working days.


HOW OUR SERVICE WORKS

As an NHS distance selling pharmacy, we do not provide face-to-face services but may use technology, including secure live video consultations, to support your care. Once you nominate us, prescriptions are received electronically, dispensed, and delivered directly to your address in accordance with our delivery and storage policies.

We will not dispense medication without a valid prescription (electronic or paper). Our pharmacists may access your NHS Summary Care Record when clinically necessary to ensure safe and effective care.


YOUR DECLARATIONS AND RESPONSIBILITIES

  • I declare that I have answered all questions truthfully and to the best of my knowledge.
  • I will read the Patient Information Leaflet before taking any prescribed medication.
  • I will contact The Care Pharmacy and inform my GP if I experience any side effects, start new medication, or if my medical conditions change during treatment.
  • I understand that prescribers rely on my answers in good faith, and providing false or misleading information could be hazardous to my health.
  • I understand that this questionnaire forms part of a request to the prescriber and that the final decision to prescribe rests with them.
  • I consent to this consultation being used to assess my suitability for treatment.
  • I understand that my medication may require cold storage and that I am responsible for ensuring it is stored correctly upon receipt.
  • I agree to be available for a follow-up video call if required.
  • I understand that I will only be charged if my consultation is approved and a prescription is issued.
  • I agree to the terms of delivery and understand that medicines will be dispatched in line with cold chain and safety requirements.

YOUR OBLIGATIONS

You are responsible for ensuring that all information you provide is accurate and up to date. Providing false or incomplete information may place your health at risk. You must take all medications exactly as prescribed, check dosage labels carefully, and refer to the accompanying patient information leaflet.

All services are provided in English. You agree to use our Site for lawful purposes only and to request medication solely for your own use or for someone for whom you are legally acting as a proxy. You must keep your account login credentials confidential.


DELIVERY AND COLD STORAGE POLICY

We deliver all prescriptions via Royal Mail or approved courier services in discreet, unbranded packaging. Most items can be posted through a letterbox; however, certain medications such as Controlled Drugs or refrigerated items will require a signature on delivery.

Refrigerated items are dispatched in temperature-controlled packaging that maintains temperatures between 2°C and 8°C. You are responsible for ensuring these items are placed in suitable cold storage immediately upon receipt. Failure to do so may affect the safety or efficacy of your medication.

We only deliver within the UK and cannot change addresses once an order has been placed. Urgent deliveries may be available via Royal Mail Special Delivery for an additional fee. Please contact us to discuss this option.


VIDEO CONSULTATIONS

In certain circumstances, our prescribers may require a video consultation before approving a prescription. By using our services, you consent to being contacted for a secure video call if clinically necessary. These sessions are used solely to confirm suitability and ensure patient safety.


LIABILITY AND LIMITATIONS

We are responsible for dispensing your prescriptions in accordance with GPhC standards and NHS Terms of Service. We do not exclude or limit liability where unlawful, including for death or personal injury caused by negligence.

We are not liable for loss or damage resulting from factors outside our control (e.g. postal delays, acts of nature, or system failures), or for indirect losses such as business interruption, loss of profit, or goodwill. Our Site is intended solely for patient use and not for commercial purposes.


UNWANTED MEDICATION

Once dispensed, medication cannot be returned, cancelled, or refunded. Unwanted medication should be disposed of safely by returning it to our pharmacy (via post, not in person) or another pharmacy for destruction.


CANCELLATIONS

You may cancel an order up until the point your medication is dispatched. Once shipped, cancellation or refund is not possible due to legal and safety regulations surrounding medicines.

We aim to acknowledge all written complaints within three working days and respond within five working days. If you are dissatisfied with our response, you may contact the General Pharmaceutical Council at www.pharmacyregulation.org/contact-us/ or by calling 020 3365 3400.


GOVERNING LAW

These Terms are governed by the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject exclusively to the jurisdiction of the courts of England and Wales.

If any part of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect.
